2023 DAYTONA INTERNATIONAL SPEEDWAY DOG FAN PHOTO CONTEST
Official Rules
RULE 1. ELIGIBILITY AND HOW TO ENTER
NO PURCHASE NECESSARY. To participate in the 2023 Daytona International Speedway Dog Fan Photo Contest (the “Contest”), you must be 18 years of age or older, a resident of the United States, be actively visiting Daytona International Speedway’s Campsite, visit https://www.daytonainternationalspeedway.com/dog-contest/ (the “Website”), and follow the online instructions for entry. The Contest begins at 12:00:00 PM Eastern Time on August 22, 2023, and ends at 12:00:00 PM Eastern Time on August 25, 2023 (the “Contest Period”). During the Contest Period, you can participate by:
• Visiting the Website and following the links and instructions to enter the Contest electronically.
RULE 2. ENTRY PROCESS
To upload your photo, go to the Website and select the ‘upload your entry’ button (each photo entry, an “Entry”). You may enter 1 photo per Entry. You may submit an unlimited number of Entries during the lifetime of the Contest. . All people included in an Entry photo (if any) must be 18 years of age or older. . Entries generated by script, macro or other automated means may be void in the sole discretion of Daytona International Speedway, LLC (“DIS”).
Rule 3. OWNERSHIP/USE OF ENTRIES: By submitting a Photo Entry, each entrant agrees DIS shall own the Photo Entry submitted (including all rights embodied therein) and that DIS and its designees may publicly display, exploit, edit, modify, distribute, reproduce and create derivative works of the Photo Entry and all elements of such Photo Entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, other DIS advertising and promotion, including on DIS’s website, social media accounts and in DIS publications, and in any and all media now known or hereafter devised, worldwide, in perpetuity without compensation, further permission or notification to entrant or any third party.
RULE 4. PHOTO ENTRY REQUIREMENTS: By entering, entrant warrants that the Photo Entry is (1) original and does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (2) has not been previously published; and (3) has not won any previous awards. If the photo contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the photo, any and all releases and consents necessary to permit the use and exhibition of the photo by DIS in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the photo. DIS reserves the right to request proof of these permissions in a form acceptable to DIS from any entrant at any time. Failure to provide such proof may, if requested, render Photo Entry null and void. By submitting a Photo Entry, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the photo, consent to the submission and use of the photo in the contest and to its use as otherwise set forth herein.
Photo Entries may not contain, as determined by DIS, in its sole discretion, any content that:
· is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
· promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
· is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Photo Entries;
· defames, misrepresents or contains disparaging remarks about other people or companies;
· contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
· contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;
· contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
· contains look-alikes of celebrities or other public or private figures, living or dead;
· communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or violates any law
Rule 5. SELECT ENTRY PHOTOS DISPLAYED
Eligible Entries will be reviewed between 12:00:00 PM Eastern Time on August 22, 2023 through 12:00:00 PM on August 24, 2023 (“Entry Period”). At the end of the Entry Period, all eligible Entry photos received will be judged by a panel of judges. The top ten (10) photos selected will be deemed as a potential winner and will be posted on https://www.daytonainternationalspeedway.com/dog-contest/ and eligible for voting on until 12:00:00 PM Eastern Time on August 25, 2023. The Contest ends at 12:00:00 PM (ET) on August 25, 2023.
Rule: 6. WINNER NOTIFICATION: First place winner will be required to personally collect the prize on August 25, 2023, per instruction via text and/or email message. Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of DIS to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by any potential winner will result in disqualification and, at DIS’s sole discretion, the prize may be awarded to a runner-up, if applicable. If any potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, DIS reserves the right to award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein.
RULE 7. PRIZES
One first place winner will receive one (1) NRE track time certificate (valued at $215.99) and one (1) Daytona International Speedway swag bag (valued at $100.00). The Approximate Retail Value of all Contest prizes is $315.99. All applicable federal, state and local taxes, any other expenses associated with prize acceptance and use not specifically listed herein as being provided (including air/ground transportation (including gas), luggage fees, meals, gratuities, delivery charges, etc.) are the responsibility of each winner. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by DIS. No substitution, transfer or cash redemption of prizes is permitted, except by DIS, which reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value. All prize details are at DIS’s sole discretion.
RULE 8. CONDITIONS OF PARTICIPATION
All personally identifiable information provided during this Contest will be treated in accordance with the Daytona International Speedway privacy policy posted here: https://www.daytonainternationalspeedway.com/privacy-policy/#UnderneathTableInfoWeCollect. By participating, you agree to these rules, https://www.daytonainternationalspeedway.com/privacy-policy/#UnderneathTableInfoWeCollect, and the decisions of DIS, which shall be final and legally binding in all matters relating to this Contest. Entrant agrees to release, discharge, and hold harmless Daytona International Speedway, LLC, NASCAR Digital Media, LLC, NASCAR Enterprises, LLC, National Association For Stock Car Auto Racing, LLC, their respective parent companies, subsidiaries, limited liability and affiliated companies, advertising and promotion agencies, and each of their respective shareholders, officers, directors, employees, members, agents and assigns (collectively, the “Released Parties”) from liability of any kind or nature for any loss, claims, damages, or injuries of any kind resulting in whole or in part, directly or indirectly from entrant’s participation in this Contest. DIS reserves the right, in its sole discretion, to modify, cancel or suspend part or all voting of this Contest should virus, bugs, non-authorized human intervention or other causes beyond the control of DIS corrupt or impair the administration, security, fairness or proper play of this Contest. The Contest may also be temporarily suspended due to routine site, server or network maintenance. DIS is not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by DIS, participants, or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the promotion. DIS may prohibit a participant from taking part in the Contest or disqualify a participant’s Entry if, in its sole discretion, it determines that the Entry does not abide by these Official Rules, and/or said participant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, or threaten any other participant or DIS representatives. Void where prohibited and subject to federal, state and local laws. In the event of a dispute regarding Entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. “Authorized account subscriber of the e-mail account” is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
CAUTION — ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE WEBSITE OR THIS CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, DIS RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
