Official Rules for the “Scan to Win Access to Victory Lane Sweepstakes”

SWEEPSTAKES PERIOD: The Scan to Win Access to Victory Lane Sweepstakes (“Sweepstakes”) begins on August 22, 2023, at 8:00 a.m. Eastern Time (“ET”) and ends on August 26, 2023, at the end of Stage 1 of the Coke Zero Sugar 400 NASCAR Cup Series™ race (“Race”) (the “Sweepstakes Period”).  If the Race is postponed or rescheduled and/or if the Victory Lane celebration for the Race is cancelled or impacted for any reason where Administrator is unable to offer access to Victory Lane, then the Sweepstakes will also be cancelled.

HOW TO ENTER: No purchase necessary to enter or win.  During the Sweepstakes Period, scan the Sweepstakes QR code with your mobile device, follow the prompts to review and agree to these Official Rules, the Website Terms of Use and the Website Privacy Policy, then enter your mobile telephone number and click “Submit.”  Or visit https://www.daytonainternationalspeedway.com/VL and follow the prompts to review and agree to these Official Rules, the Website Terms of Use and the Website Privacy Policy, enter your mobile telephone number and click “Submit.”  Limit one entry per person/mobile telephone number for the entire Sweepstakes Period.  Entries generated by script, macro or other automated, or mechanical, means or by any means which subvert the entry process are void.  All entries become the sole property of the Administrator and will not be returned. Released Parties (as defined below) are not responsible for incomplete, lost, late, damaged, delayed, illegible, or misdirected entries.  Incomplete, illegible, or fraudulent entries will be void.  Because you are participating using a mobile device, standard data charges may apply from your carrier.

ELIGIBILITY: Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, who are of the age of majority or older in their place of residence and who attend or are in close geographic proximity to the events surrounding the Coke Zero Sugar 400 Race at Daytona International Speedway during the weekend of August 26, 2023, with a mobile device capable of sending and receiving text messages. No Race ticket is required to participate.  Employees, officers and directors of Daytona International Speedway, LLC (“Administrator”), National Association for Stock Car Auto Racing LLC; drivers, teams and properties that participate in NASCAR-sanctioned events; and each of their respective parents, subsidiaries, limited liability and affiliated companies, and advertising and promotion agencies, and each of their respective family members (parent, child, spouse, sibling, and their respective spouses, regardless of where they reside), and members of their households, whether or not related, are not eligible to enter or win. Sweepstakes is subject to all applicable federal, state, and local laws. Void where prohibited by law.

Drawing: Five (5) potential winners will be selected at random in a drawing held shortly after the end of Stage 1 of the Race, from among all eligible entries received during the Sweepstakes Period.  Odds of winning depend on the number of eligible entries received.

WINNER NOTIFICATION:  Potential winners will be contacted via text message at the mobile telephone number provided in the entry immediately following the drawing, and will be given instructions about where and when to meet their guide, who will take them to Victory Lane after the Race.  Potential winners must respond to the text message notification within thirty (30) minutes indicating whether they accept or decline the Victory Lane access prize.  All winners will be required to execute and return a declaration of eligibility, a publicity release (except where prohibited), and a liability release before receiving their Victory Lane access and in order to formally claim the prize. If a potential winner is outside the Speedway and does not have a ticket to the Race, potential winner must respond to the notification text explaining the situation, and a representative of Administrator will meet the potential winner outside the Speedway to obtain the required documentation and to escort winner and guest (if applicable) into the Speedway to await the Victory Lane celebration following the Race.  If a text notification fails to go through as undeliverable, or if a potential winner fails to respond to the text notification within thirty minutes to accept or decline the prize, or if a potential winner fails to meet at the designated location at the designated time, or if a potential winner fails to sign and return the required documentation, or if a potential winner is determined to be ineligible or not in compliance with these Official Rules, or if a potential winner declines the prize for any reason, that potential winner will be disqualified and the prize may be awarded to an alternate winner, who will be selected and notified in accordance with these Official Rules, time permitting. Administrator reserves the right not to award a prize if it is unable to confirm a winner for that prize after two attempts, or in time to reasonably confirm an alternate winner before the end of Stage 2 of the Race, whichever occurs first and as determined in its sole discretion. If a prize is forfeited for any reason after the prize has already been confirmed and awarded, then no alternate winner will be selected.  If any potential winner is at least eighteen (18) but still considered a minor in his/her jurisdiction of residence, Administrator reserves the right to award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein.  Guests of winners must sign and return a liability and publicity release prior to joining winner in the Victory Lane celebration. Guests may only be under the age of 18 if the winner is the parent or legal guardian.

PRIZE: Five (5) winners will each receive two (2) passes total, one for the winner and one (1) guest to attend the celebration in Victory Lane with the driver and team that wins the Race immediately following the Race.  The Approximate Retail Value (“ARV”) of each prize is $600.00.  Total ARV of all prizes is $3,000.00.  If a winner does not use the guest pass, then the prize value will be adjusted accordingly.  Prize does NOT include race tickets, travel, hotel, meals or any other costs or expenses associated with using the prize, all of which are the sole responsibility of the winner.  All applicable federal, state and local taxes are the responsibility of the winner.  Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Administrator. No substitution, transfer or cash redemption of prizes is permitted, except by Administrator, which reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value. All prize details are at Administrator’s sole discretion. If the Race is cancelled or rescheduled for any reason, or if weather, track conditions, or other events impair the ability of Administrator to offer the Victory Lane access, as determined in its sole discretion, then the prize will be forfeited and there will be no compensation or substitution of prize.  There shall be no substitution of prize or compensation if winner is unable to attend the Victory Lane celebration by reason of illness, family emergency, personal events, travel delays or cancellations, terrorism, labor strikes, weather, pandemic or other acts beyond Sponsor’s control.

GENERAL CONDITIONS: By entering this Sweepstakes and/or accepting any prize, entrant agrees: (1) to release, discharge and hold harmless Daytona International Speedway, LLC, National Association for Stock Car Auto Racing, LLC and their respective parents, subsidiaries, limited liability and affiliated companies, advertising and promotion agencies, and each of their respective shareholders, officers, directors, employees, members, agents and assigns, the Daytona Beach Racing & Recreational Facilities District,  City of Daytona Beach and County of Volusia (collectively, the “Released Parties”) from liability of any kind or nature for any loss, claims, damages, or injuries of any kind resulting in whole or in part, directly or indirectly from entrant’s participation in this Sweepstakes or from the acceptance and use/misuse of any prize, including but not limited to participation in the Victory Lane celebration; and (2)  to abide by, and be bound by these Official Rules and the decisions of the Administrator relating to participation in the Sweepstakes, selection of winners and awarding of prizes, which shall be final. Acceptance of any prize constitutes permission to use winner’s name, biographical information, city and state of residence, voice, photograph, image and/or likeness for advertising, promotional and other purposes in any and all media now known or hereafter devised, worldwide, in perpetuity, without further compensation, notification or permission from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so, unless prohibited by law. Winners and guests assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Sweepstakes or participation in the Victory Lane celebration.  Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, cellular, wi-fi, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, or in any Sweepstakes-related materials.  Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes.  Released Parties are not responsible for injury or damage to any person's computer or mobile device related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website, or scanning or using the QR Code.  Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Administrator, will be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in Administrator’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Administrator, corrupt or impair the administration, security, fairness or proper play, or submission of entries, or should the Sweepstakes be unable to run as planned for any other reason, Administrator reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winners in a random drawing from among all eligible, non-suspect entries received prior to action taken, if any. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. In the event of a dispute regarding the identity of an entrant, the individual assigned by the applicable carrier to the mobile telephone number submitted in the entry will be deemed to be the entrant and must comply with these Official Rules.

FORUM SELECTION:  This Sweepstakes shall be governed by the laws of the State of Florida. Each entrant knowingly and voluntarily intends and agrees that (i) the mandatory, exclusive venue for any action in any way related to or arising out of this Sweepstakes or prizes awarded shall be resolved individually without resort to any form of class action and shall be the state and federal courts in and for Volusia County, Florida; and (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Sweepstakes, but in no event attorneys' fees. Each entrant hereby knowingly and voluntarily waives any and all objections to venue and personal jurisdiction in the foregoing and submit themselves thereto. Each entrant hereby waives any right it may have to assert the doctrine of forum non conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this paragraph and stipulates that the aforementioned courts shall have in personam jurisdiction and venue over them for the purpose of litigating any dispute, controversy, or proceeding arising out of or related to this Sweepstakes.

CLASS ACTION WAIVER:  Each party agrees that an arbitrator, judge, magistrate, or other similar authority may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding, and that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. You agree to waive any right to a jury trial or to participate in a class action.
